More than 55% of parents in our surrogacy programmes are gay couples who have felt a calling for parenthood at some point in their lives. Surrogacy is often the best way for gay couples to achieve parenthood due to the improbability of successfully completing an international adoption process.

Surrogacy for gay couples has become increasingly limited to fewer countries. Unfortunately, over the years, surrogacy has been banned in countries such as Nepal, Thailand, Cambodia, Laos, and Vietnam.

We are not saying that surrogacy was explicitly allowed for gays or heterosexual couples in these countries. In those mentioned countries, there was no specific surrogacy law, and those who completed the surrogacy process took advantage of a "legal vacuum." The premise was, "what the laws do not prohibit is allowed." Now, these countries have introduced legislation, which does not include surrogacy for gays.


Although many countries allow surrogacy processes, not all of them accept gay couples. This significantly reduces the list of available destinations compared to heterosexual couples, who have more than 10 options for the surrogacy process.

In which countries is surrogacy allowed for gays?

These countries have specific legislation that grants the intended parent or parents the right to carry out a surrogacy process.

These laws transfer parental rights from the surrogate mother to the intended parents. These countries have laws drafted by their parliaments or subsequently modified by high court rulings that allow surrogacy processes. The countries where surrogacy can be legally performed are:

  • USA
  • ALBANIA

Then there are countries without specific legislation where surrogacy processes can still be performed because their courts recognize them:

  • MEXICO*
  • COLOMBIA**
  • ARGENTINA***

* There is no law, but there is ample jurisprudence that allows it.
** There is no law, but surrogacy processes are carried out
*** There is no surrogacy law, leading to a significant legal vacuum.

SURROGACY IN USA


Gestlife is headquartered in Miami, Florida, as part of the Investmedical group. We have been facilitating surrogacy processes for same-sex couples in the USA since 2012.

The United States was the first country to approve “commercial” surrogacy, which includes compensation for the surrogate mother.

The United States issues a court ruling which is currently recognized by the EU states.

Due to the lack of social security coverage, intended parents must bear all medical expenses that may arise. The cost of a program for a single baby can be up to $170,000.

Programs typically do not include unlimited embryo transfers within the initial price. If the surrogate does not become pregnant on the first attempt, additional costs may be incurred.

SURROGACY IN CANADA


Canada has an altruistic surrogacy law, meaning the surrogate cannot receive any compensation.

Offering compensation is punishable by up to 10 years in prison and a fine of CAD 500,000.

Surrogates cannot advertise, nor can the intended parents advertise for a surrogate. There are waiting lists of up to 5 years to find a surrogate willing to carry a baby for strangers without compensation.

Agencies, doctors, and lawyers are forbidden from acting as intermediaries under penalty of up to 3 years in prison, so no agency has its own infrastructure in Canada.

It is an ideal country for surrogacy if you are Canadian and have a cousin, sister, or friend willing to undergo the process for free.

SURROGACY IN ALBANIA

Surrogacy in Albania for Gays


Law 8876, dated 4.4.2002 on Reproductive Health, article 43 recognizes surrogacy as an assisted reproductive technique in Albania, although specific regulations have not yet been developed. Albania has become a natural substitute for Russia since surrogacy for foreigners was banned there in May 2022.

Albania respects the sexual orientation of each person, being a tolerant country where five religions coexist peacefully. Additionally, Albania is a member of NATO.

Due to its proximity to EU countries, the absence of visa requirements for travel, the excellence of its clinics, and the modernity of the country, Albania has become a preferred destination for same-sex couples seeking surrogacy.

SURROGACY IN MEXICO

Surrogacy for gays in Mexico


There is no explicit surrogacy law in Mexico. Some states, such as Sinaloa, Querétaro, Coahuila, and San Luis Potosí, explicitly prohibit it. Tabasco and Sinaloa limit the right to surrogacy processes to Mexican citizens only. The rest of Mexican states have no specific legislation on surrogacy, neither for nor against it.

In Mexico City (DF), there is no surrogacy law per se, but there is a proposed law focused on securing the affiliation rights of the intended parents and extensive case law granting rights to intended parents.

Parents considering Mexico as a surrogacy destination should be aware that in the absence of explicit legislation, they may be subject to future legislative changes, whether favorable or unfavorable. However, any legislative change could not be applied retroactively.

SURROGACY IN COLOMBIA


Colombia is a country where surrogacy is practiced by clinics. There is no specific law on surrogacy, but the courts end up withdrawing custody from the surrogate mother since she has no genetic link to the baby.

One of the main advantages of this country is the cost, which is much lower than in the United States.

Law in COLOMBIA

There is no explicit surrogacy law in Colombia. This is important to consider if you choose this country for surrogacy.

The surrogacy process takes place in the capital city of Bogotá, with additional programs available in Cartagena de Indias.

Once the baby is born, a validation process confirms the maternity of the surrogate mother. It will be proven that the baby has a genetic link with the intended father and no link with the surrogate mother. The court then issues an order to legally separate the rights of the surrogate mother from the baby.

As of now, no new bills have been proposed to regulate surrogacy in Colombia. According to the Minister of Justice and Law, there are no current plans to present such a bill due to a complex legislative agenda.

Registration in Colombia

After the birth, the intended parents must register the baby in the civil registry of Bogotá, Colombia. A birth certificate issued by the clinic is required for this purpose.

The maternity agreement will be initiated by the surrogate mother. This allows for obtaining a passport and safe passage waiver, depending on the nationality of the parents. Consult your case with your family advisor at Gestlife.

For the biological father, the surrogate mother initially appears on the birth certificate. She will be removed once the court accepts the order, as the surrogate mothers have no genetic link to the child.

SURROGACY IN ARGENTINA


Argentina has recently become a destination for surrogacy.

Although there is no specific surrogacy legislation, the law permits the signing of a surrogacy agreement, and a 2017 regulation allows a child born through surrogacy to be registered in the name of the intended parent.

The country is currently facing a major economic crisis, with inflation exceeding 140% per year, leading to difficulties in making payments or repayments due to government restrictions on capital movements.

SURROGACY IN RUSSIA


You may have heard about or met parents who did their surrogacy with Gestlife in Russia. For 15 years, this was possible. However, in May 2022, the Russian Parliament banned surrogacy for foreigners, removing Russia from the list of countries where same-sex couples can pursue surrogacy.

SOME DANGEROUS "INVENTIONS" IN SURROGACY

Just as an Aussie would say a “bit dodgy”. Not everything that appears to be surrogacy is real surrogacy.


Surrogacy occurs when there is a law or legal precedent that allows it and legally gives the rights to the intended parent or parents. Nothing else, even if it appears similar, is not truly surrogacy.

This primeness is crucial because in countries without surrogacy laws or legal recognition, the surrogate will be considered the mother of the child, with rights over the baby if she wishes. At Gestlife, we aim to avoid any legal complications in the future.

Recently, some "agencies" have emerged, particularly targeting the LGTBI community, offering destinations that do not provide minimum legal or medical guarantees. These are countries with little or no experience in surrogacy, without laws to protect it. In these places, surrogate mothers receive very low compensation (sometimes against existing laws), often not exceeding $10,000, compared to $50,000 for an American surrogate or $24,000 for a Ukrainian surrogate.

Czech Republic


The Czech Republic has attracted many parents who mistakenly believe it offers an easier surrogacy process, often leading to serious legal issues.

Frequently, parents used fertility clinics in Kharkov, Ukraine, where the surrogate became pregnant before being sent to the Czech Republic to deliver the baby. This took advantage of the Czech Republic's EU and Schengen area status, where a passport is not required for the baby to travel to the parents' home country. This was particularly useful for parents from countries that temporarily do not issue passports for surrogate-born babies, like Spain. Therefore, the Czech Republic is not a recommended destination for surrogacy.

Belgium


Belgium prohibits commercial surrogacy, and even altruistic surrogacy agreements are null and void, preventing the registration of the baby in the intended parents' names. This contradictory law allows a few clinics to offer surrogacy to Belgian parents (hetero couples), but the law does not support this act. Therefore, Belgium is not a recommended country for surrogacy.


Netherlands


The Netherlands prohibits commercial surrogacy. Luxembourg equates surrogacy to organ trafficking and does not allow it.


Austria


Surrogacy is forbidden by law in Austria. Therefore, it is not a recommended country for surrogacy.



Poland


Surrogacy is forbidden by law in Austria. Therefore, it is not a recommended country for surrogacy.

Countries Without Specific Legislation on Surrogacy for Same-Sex Couples.

Some agencies offer surrogacy in countries without specific legislation, operating under the premise that what is not forbidden is allowed. While it is easy to find a clinic willing to perform the surrogacy process, these countries often lack necessary medical and legal guarantees.


While the medical aspects are straightforward for a fertility clinic, surrogacy is not just about "creating" a child. It also involves ensuring that the child is legally recognized as yours and that there are no legal issues leaving the country or later in your home country.


Problems arise in countries without specific surrogacy laws. Without a law to annul the natural rights of the surrogate, the surrogate is considered the legal mother.


In these cases, she retains all rights over the child, which can lead to significant issues, including extortion for large sums of money or preventing the child's recognition and departure from the country. Authorities in these countries will recognize her as the mother, leaving intended parents with no legal recourse. Therefore, we strongly advise against surrogacy in such countries due to the lack of legal guarantees for parents. Countries like Guatemala recently appeared on this list, offering no legislation or guarantees

COUNTRIES WITH LEGISLATION ON ALTRUISTIC SURROGACY

There are two types of surrogacy laws:


Altruistic gestation: in this type of legislation, a maximum is established for the compensation that the gestational carrier can receive, since the law intends that the gestational carrier does not enrich herself.


In certain countries, the figure ranges from zero, in the former Portuguese law (currently annulled by the Portuguese Constitutional Court), to 20,000 Canadian dollars in Canada. Paying a higher amount to the pregnant woman is a crime punishable by imprisonment.


Commercial gestation: although we do not like this name, it refers to legislation that allows the gestational carrier to be paid a compensation agreed between the parties, without setting limits.

Hybrid or crossborder programs

Due to the scarcity of destinations where surrogacy can be performed for same-sex couples, crossborder programs are often created in order to offer an alternative, but do not offer the same guarantee as in a country where there is legislation.

These are usually programs that start in one country and end in another, in order to comply with the laws of both countries.

They are not illegal programs, however, as we have said, they do not offer the same legal guarantees as those developed in countries where there is a specific surrogacy law.

This type of program has expanded a lot in the United States, where the payment to the pregnant woman is high (between 55,000 and 65,000 USD on average) and the in vitro fertilization process for a single embryo transfer can cost between 22,000 and 28,000 USD.

In order to reduce the price of the programs, and to be more "competitive" than most American agencies, some agencies invented crossborder programs with Mexico, where the surrogate, instead of being American, is Mexican, and the IVF is also performed in Mexico, at prices much lower than what it would cost in the USA

What apparently seemed like a good idea, has turned out to be a disaster in most cases in recent years. Both the incorrect involvement of the surrogate women used coming from Mexico, and the quality of the medical services of some of the Mexican clinics ended well.

Nowadays most agencies have abandoned this formula, due to its results, but it is possible that you can still find a small agency that offers it to you. Be careful. Here, more than anywhere else, cheap is expensive.

Is surrogacy legal in Kenya for gays?



This type of process is reserved for Kenyan citizens, and does not offer any guarantee to foreign citizens. Once again, the pregnant woman has rights over the baby


CONCLUSION

Things that have a value at a lower price is not what it seems. What is cheap always ends up being expensive, as our parents and grandparents have taught us so many times. In surrogacy, there is no room for gimmicks, because immediately the full weight of the law can fall on your shoulders. If it is possible to offer viable programs with absolute legal certainty in one of these countries, Gestlife would already have an office there.
