There is a law that allows surrogacy in Canada to foreigners. Penalties for non-compliance with the law are not minor:



60 A person who contravenes any of sections 5 to 7 and 9 is guilty of an offence and:

  2. is liable, on summary conviction, to a fine not exceeding $100,000 or to imprisonment for up to two years, or to both.


Therefore, if any company offers you a surrogacy process in CANADA, you must know that they are committing an illegal act, and what is more serious, they are also implicating you in the same crime.

We do not understand why they offer this destination, when there are others. The surrogacy law in Canada was made just for Canadians, who have a sister, a sister-in-law, a cousin or a friend who, free of charge, wants to gestate a baby for the intended parents. They can do so with legal guarantees for all parties. The law was not made so that foreigners would flock to that country to achieve our goal of becoming parents.

Every month we receive calls from parents who have started more than a year ago, a surrogacy process in CANADA, either directly or through an agency. After one or two years, without finding a surrogate, they give up.
