It is important, when you want to undertake a LGTBIQ+ surrogacy to understand that there are three types of countries where you can carry out a surrogacy process. Obviously, there is a fourth group which are the countries where it is forbidden to carry out a surrogacy process. We will not talk about it in order not to waste your time.
These countries have a specific legislation that develops the right of the intended parent or parents to carry out a surrogacy process.
These legislations transfer the rights over the child from the surrogate mother to the intended parents. These countries have laws drafted by their parliaments or subsequently modified by rulings of high courts allowing surrogacy processes. These are the countries where a surrogacy process can be performed because the law contemplates them:
Then there are the countries without having specific legislation where surrogacy processes can normally be performed since their courts recognize them:
* There is no law, but there is ample jurisprudence that allows it.
** There is no law, but surrogacy processes are carried out

The United States was the first country to approve "commercial" surrogacy (with compensation to the surrogate mother).
The United States issues a court ruling which is currently recognized by the EU states.
Since there is no social security, and the intended parent must bear all the medical expenses that may arise, the price of a program for a single baby can be up to $170,000.
The programs are not usually unlimited (with an unlimited number of embryo transfers in the price.) So, if the pregnant woman does not get pregnant at the first attempt, there will be significant more costs.

CANADA is a country with an altruistic law, where the pregnant woman cannot receive any compensation.
Offering any compensation is punishable by 10 years imprisonment and a fine of CAD 500,000.
The gestational carrier cannot advertise, nor can the commissioning parents advertise for them. There are waiting lists of up to 5 years to find a gestational carrier, who will be willing to gestate a baby for strangers free of charge.
Agencies are prohibited from acting as intermediaries (also doctors and lawyers) under penalty of 3 years of imprisonment, so no agency has its own infrastructure in that country.
It is an ideal country for surrogacy, if you are Canadian, and you have a cousin, a sister or a friend willing to do the process for free.

Law 8876, dated 4.4.2002 on Reproductive Health, in its article 43 recognizes surrogacy as an assisted reproductive technique allowed in this country, although it has not yet developed a specific regulation. Albania has become the natural substitute for Russia, after the prohibition in that country of surrogacy procedures for foreigners since May 2022.
It is a country that respects the sexual condition of each person, since it is a tolerant country where 5 religions coexist peacefully. Albania is also part of NATO.
Because of its proximity to EU countries, the absence of visa requirements for travel, the excellence of the clinics, and the modernity of the country, it has become a preferred destination for gay couples.

There is no explicit surrogacy law in Mexico. Some states, such as SINALOA, QUERÉTARO, COHAHUILA and SAN LUIS POTOSI, have it explicitly prohibited. TABASCO and SINALOA. limit the right to carry out processes only for Mexican citizens. The rest of the Mexican states have no legislation in this regard, neither for nor against.
In MEXICO DF there is no surrogacy law per se, but there is a proposed law focused on securing the affiliation rights of the intended parents and extensive case law granting rights to intended parents.
Parents wishing to choose Mexico as a destination should be aware that in the absence of explicit legislation, they are always exposed to future legislative changes, for or against, although any legislative change could never be applied retroactively.

Colombia is a country where surrogacy is now practiced by clinics. There is no specific law on surrogacy, although the courts end up withdrawing custody from the surrogate mother since she has no genetic link with the baby.
One of the main advantages offered by this country is its prices, which are much cheaper than in the United States.
There is no explicit surrogacy law in COLOMBIA. This is something you have to take into account if you finally choose this country to become a father.
The surrogacy process takes place in the capital city of Bogota, although we also have programs in the city of Cartagena de Indias.
Once the baby is born, a process of validation of the maternity of the gestational mother takes place. It will be proven that the baby has a genetic link with the intended father, and on the contrary, has no link with the gestational mother. The court definitively disassociates the gestational mother from the baby, by means of court order.
As of today, no other bill has been presented that intends to regulate surrogacy in Colombia and according to interviews with the Minister of Justice and Law, it will not be presented for the time being due to the complex legislative agenda.
LEGAL WARNING:
Obviously, we cannot guarantee that there will be new bills in the future, for or against surrogacy, which is something that can happen in any country. However, no new law can be applied with retroactive effect. So when there is a normative change, the ongoing processes are respected. This happened in the other countries where there was a legislative change against surrogacy: VIETNAM, LAOS, CAMBODIA, MEXICO, RUSSIA, NEPAL, or THAILAND.
However, if the absence of legislation is a problem for you, you can do the process in the other countries where Gestlife has its own offices, and they have programs for homosexual couples.
After the birth, the intended parents must register the baby in the civil registry of BOGOTÁ COLOMBIA. For this purpose, a birth certificate issued by the clinic must be provided.
The maternity agreement will be initiated by the pregnant woman. This way, the passport, and waiver of safe passage (depending on the nationality of the parents) is obtained. Consult your case with your family advisor at Gestlife.
In the case of the biological father, the pregnant woman appears on the birth certificate. Subsequently it will be removed when the court accepts the court order (which always happens because the mothers have no genetic link with the child).

Argentina is a destination that has recently appeared on the surrogacy world map.
Although there is no express legislation on surrogacy, the law allows the signing of a surrogacy agreement and there has been a regulation since 2017 specifying that a child born through surrogacy can be registered in the name of the intended parent.
This country, immersed in a major economic crisis (with inflation exceeding 140% per annum), is experiencing difficulties in making payments or repayments, due to the restrictions on capital movements set by the government.

Surrogacy occurs when there is a law or jurisprudence that allows it and legally assigns the rights of the gestational carrier to the intended parent or parents. The rest, although it may seem so, is not surrogacy.
And the nuance has a vital importance, because in those countries where there is no surrogacy law, or the jurisprudence does not contemplate it, the gestational carrier will the mother who birthed the child, with rights over the baby if she wishes. Some "agencies" have been appearing lately, offering especially to the LGTBI community destinations that do not offer the minimum guarantees, neither legal nor medical. Countries with little or no experience in surrogacy, without a law to protect it. Countries where surrogate mothers receive a ridiculously low compensation (sometimes against existing laws), which do not exceed 10,000 USD, when an American surrogate receives 50,000 USD, or a Ukrainian mother 24,000 USD.
This type of programs were made up because the end of the program is developed in many occasions, in a European country, where there is no specific surrogacy law. Some parents resort to this program if they cannot resort to another one for economic reasons Some because the process takes place at the end in a country within the Schengen area, which allows them to return to the country of origin with certain ease.

The Czech Republic has been one of the destinations where more parents have fallen into the temptation of "making their process apparently easier", at the cost of incurring in serious crimes.
Most of the time, the parents resorted to the services of a fertility clinic in Kharkov (Ukraine) where the surrogate woman became pregnant and was then sent to the Czech Republic to have the baby. She took advantage of the fact that this country is part of the EU and is within the Schengen area where it is not necessary to issue a passport for the baby to travel to the country of the intended parents. This was useful for those parents whose country of origin (as is temporarily the case in Spain) does not issue a passport for the baby.
Therefore, the Czech Republic is not a recommended destination for surrogacy.

Belgium prohibits commercial surrogacy, and the law determines that whatever the agreement signed between the parties. Even in altruistic surrogacy, it is null and void,and prevents the registration of the baby in the name of the intended parents. It is a country with a contradictory law since there are two or three clinics that offer surrogacy to Belgian parents (hetero couples) but then the law does not support this act. Therefore, it is not a recommended country for surrogacy.
The Netherlands prohibits commercial surrogacy. Luxembourg do not allow surrogacy, equating it criminally to organ trafficking.
In Austria surrogacy is forbidden by law. Therefore, it is not a recommended country for surrogacy.

Following the premise that what is not forbidden is allowed, some agencies offer destinations where there is no specific surrogacy legislation. It is always easy to find a clinic that is willing to carry out the surrogacy process, but often they do not offer the necessary medical and legal guarantees.
After all, the medical part does not present too many secrets for a fertility clinic. But surrogacy is not only about "creating" a child, but also about guaranteeing that the child will be recognized as your child, Also that there will be no legal problems, neither to leave the country nor to have it later in your country.
And that is where the problems begin in these countries that lack a specific surrogacy law. Because in the absence of a law that annuls the natural rights of the surrogate "mother is the one who gives birth." According to most legislations in the world in favor of the intended parents, the surrogate in these cases retains all the rights over the child.
In other words, she is the mother for all purposes and keeps all her rights intact. If she wishes, she can prevent the child from being recognized as your child from leaving the country, or she can even extort huge sums of money from you. She is the mother and the authorities in her country recognize her as such. We cannot do anything in the courts of her country if anything happens. Therefore, we strongly advise against doing surrogacy in this type of country as there are no legal guarantees for the parents. In this list of countries, countries such as Guatemala appear recently, where there is no legislation of any kind and there are no guarantees whatsoever.

There are two types of surrogacy laws:
Altruistic gestation: in this type of legislation, a maximum is established for the compensation that the gestational carrier can receive, since the law intends that the gestational carrier does not enrich herself.
In certain countries, the figure ranges from zero, in the former Portuguese law (currently annulled by the Portuguese Constitutional Court), to 20,000 Canadian dollars in Canada. Paying a higher amount to the pregnant woman is a crime punishable by imprisonment.
Commercial gestation: although we do not like this name, it refers to legislation that allows the gestational carrier to be paid a compensation agreed between the parties, without setting limits.
Due to the scarcity of destinations where surrogacy can be performed for same-sex couples, crossborder programs are often created in order to offer an alternative, but do not offer the same guarantee as in a country where there is legislation.
These are usually programs that start in one country and end in another, in order to comply with the laws of both countries.
They are not illegal programs, however, as we have said, they do not offer the same legal guarantees as those developed in countries where there is a specific surrogacy law.
This type of program has expanded a lot in the United States, where the payment to the pregnant woman is high (between 55,000 and 65,000 USD on average) and the in vitro fertilization process for a single embryo transfer can cost between 22,000 and 28,000 USD.
In order to reduce the price of the programs, and to be more "competitive" than most American agencies, some agencies invented crossborder programs with Mexico, where the surrogate, instead of being American, is Mexican, and the IVF is also performed in Mexico, at prices much lower than what it would cost in the USA
What apparently seemed like a good idea, has turned out to be a disaster in most cases in recent years. Both the incorrect involvement of the surrogate women used coming from Mexico, and the quality of the medical services of some of the Mexican clinics ended well.
Nowadays most agencies have abandoned this formula, due to its results, but it is possible that you can still find a small agency that offers it to you. Be careful. Here, more than anywhere else, cheap is expensive.
This type of process is reserved for Kenyan citizens, and does not offer any guarantee to foreign citizens. Once again, the pregnant woman has rights over the baby
Things that have a value at a lower price is not what it seems. What is cheap always ends up being expensive, as our parents and grandparents have taught us so many times. In surrogacy, there is no room for gimmicks, because immediately the full weight of the law can fall on your shoulders. If it is possible to offer viable programs with absolute legal certainty in one of these countries, Gestlife would already have an office there. For these reasons, the total absence of legislation, jurisprudence, and without legal and medical guarantees, prevents us from being able to recommend this type of destination.
Finally, we would like to warn you about some agencies who offer original destinations, as if they were travel agencies where you can choose a destination à la carte.
They offer processes that usually start in one country (where it is sometimes legal to perform IVF, sometimes not) but end in countries where there is no or restricted legislation. They offer delivery in countries such as:
All these countries lack legislation or have restrictive legislation which can imply serious setbacks when it comes to not breaking the law and being able to return to your country and not have problems with the authorities.
